Mr. Omoyele Sowore, publisher of Sahara Reporters and convener of #RevolutionNow movement was arrested on August 3rd, two days before a rally tagged “Revolution Now” for allegedly plotting to overthrow an elected government.
The prosecutor is asking the Court to disallow the respondent bail due to the fresh charges filed against him. In response to this the counsel to Mr. Sowore said the application for bail was withdrawn and the prosecutor’s application for further detainment was also withdrawn. He stressed that the new charges can’t bring about a detainment order.
Mr. Sowore’s lawyer, Mr Falana urged the court to disregard the submission on the prosecutor. Mr Falana said the prosecutor can not ask the court to detain a citizen prospectively and in anticipation of the arraignment of the defendant order his detention.
Mr. Omoyele Sowore has now been ordered to be released from the custody of the Department of State Service with immediate effect. This follows the withdrawal of the application by the state counsel, Justice Taiwo Taiwo of the Federal High Court, Abuja, presiding over on Tuesday, said Sowore should be released to his lawyer, Mr. Femi Falana (SAN).
Mr. Sowore’s lawyer, Femi Falana, convinced the court to order swift release of his client as the prosecutor is no longer interested in detaining him any further. This was however, challenged by the Counsel to the DSS, saying that a formal suit has been filed where Mr. Sowore is being accused of treasonable felony which is a capital offence.
However, since charges had already been filed against the activist,the presiding judge stated that he must deposit his passport and other travel documents to guarantee his availability for trial also Mr. Femi Falana has been saddled with the responsibility of making Mr. Omoyele Sowore, his client available whenever required.
